EULA - End User License Agreement

IntelliSoft32 ServerBackup License Agreement

You should carefully read the following terms and conditions before using this software. Unless you have a different license agreement signed by IntelliSoft32 Software your use of this software indicates your acceptance of this license agreement and warranty. Installing and using ServerBackup signifies acceptance of the terms and conditions of this license agreement. If you do not agree with the terms and conditions of this license agreement you must remove ServerBackup files from your storage devices and cease to use the product.

Evaluation and Registration
This is not free software. You are hereby licensed to use this software for evaluation purposes without charge for a period of 30 days. If you use this software after the 30-day evaluation period, a registration fee is required. When payment is received you will be sent a registration key. After registration, one registered copy of ServerBackup (hereafter referred to as "Software") may either be used by a single person who uses the Software personally on up to 3 of his/her computers or installed on a single computer used non-simultaneously by multiple people, but not both.

You may access the registered version of ServerBackup through a network, provided that you have obtained individual licenses for the Software covering all the computers that will access the Software through the network. For instance, if 10 different computers will access ServerBackup on the network, each computer must have its own ServerBackup license, regardless of whether they use ServerBackup at different times or concurrently.

Distribution
Provided that you verify that you are distributing the Unregistered Version, you are hereby licensed to make as many copies of the Unregistered Version of this software and documentation as you wish, give exact copies of the original Unregistered Version to anyone, and distribute the Unregistered Version of the software and documentation in its unmodified form via electronic means. There is no charge for any of the above. You are specifically prohibited from charging or requesting donations for any such copies however made, and from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission.

You are specifically prohibited from distributing the Registered version of ServerBackup and/or your registration key.

Disclaimer of Warranty
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. IN NO EVENT WILL INTELLISOFT32 SOFTWARE BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS. Because of the various hardware and software environments into which ServerBackup may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the Software.

Copyright and Trademark Rights
The Software is owned by IntelliSoft32 Software. This Agreement does not grant you any intellectual property rights in the Software. IntelliSoft32 Software owns Copyright and all Intellectual Property Rights to the Software and to any copies made of the Software.

Restrictions
You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software. You may not use, copy, modify or transfer copies of the Software except as provided in this license. You may not decompile, disassemble, or create derivative works based upon the Software. You may not modify, adapt, translate, or create derivative works based upon the written documentation. You may not sub-license, rent, lease, sell or assign the Software to others.

Governing Law
This Agreement shall be governed by, construed and enforced in accordance with the internal substantive laws (and not the laws of choice of laws) of South Australia, Australia, without giving effect to the conflict of laws provisions. Sole venue shall be in the applicable state and federal courts of South Australia.
